1. Purpose and Legal Framework

This notice is issued in accordance with the Consumer Protection Act, No. 68 of 2008, which came into effect on 1 April 2011. The Act aims to promote a fair, accessible, and sustainable marketplace for consumer products and services in South Africa. It establishes national norms and standards for consumer protection, prohibits unfair business practices, and empowers consumers with enforceable rights.

2. Scope of Application

This notice applies to all goods and services offered by Heidelquip (Pty) Ltd T/A Agriquip in the ordinary course of business. It outlines the rights of consumers and the obligations of our company under the CPA and its associated regulations.

  • Right to Fair and Responsible Marketing
  • Right to Fair and Honest Dealing
  • Right to Fair, Just and Reasonable Terms and Conditions
  • Right to Safe and Good Quality Goods
  • Right to Accountability from Suppliers

4. Supplier Obligations

  • Provide accurate and transparent information about all products and services
  • Ensure fair business practices in all consumer interactions
  • Honour statutory warranties and guarantees
  • Maintain ethical marketing and advertising standards
  • Facilitate accessible dispute resolution mechanisms
  • Protect consumer data in accordance with POPIA (Protection of Personal Information Act)

5. Product Safety, Warranties and Guarantees

  • Statutory warranties as per Section 56 of the CPA
  • Additional voluntary guarantees, where applicable, clearly stated at the point of sale
  • Compliance with product safety regulations, including risk assessments and quality control

6. Returns, Refunds and Repairs

  • Defective or unsafe
  • Not as described or do not meet the intended purpose
  • Returned within the prescribed period (typically 6 months from delivery)

Refunds, repairs, or replacements will be processed in accordance with Section 20 and 56 of the CPA and our internal returns policy.

7. Dispute Resolution Process

  • Consumers are encouraged to contact Heidelquip (Pty) Ltd T/A Agriquip directly
  • If unresolved, the matter may be escalated to the Consumer Goods and Services Ombud (CGSO)
  • Alternatively, the matter may be referred to the National Consumer Commission (NCC)

Both bodies offer alternative dispute resolution (ADR) mechanisms to facilitate fair outcomes.

8. Compliance with CPA Regulations

  • Product labeling requirements (ingredients, safety instructions, expiry dates)
  • Advertising standards to prevent deceptive practices
  • E-commerce protections, including secure payment and data handling
  • Penalties for non-compliance, including fines and corrective measures
